Terms of Use
These Terms of Use for “Starbucks Delivers” Online Food Ordering Services shall apply where a Starbucks Rewards™ program member or such other user of the “Starbucks Delivers” online food ordering services (the “Online Food Ordering Services”) (a “user” or “you”) uses the Online Food Ordering Services through Starbucks Thailand mobile application (“Starbucks App”) and constitute a legally binding agreement between you and Coffee Concepts Retail Co., Ltd.
You may use the Online Food Ordering Services in accordance with these Terms of Use. Please read carefully and fully understand these Terms of Use. Before you place an order via the Online Food Ordering Services, you are required to confirm, by checking the relevant box that you have read, understood and accepted these Terms of Use.
The Online Food Ordering Services are only available to users accessing the Starbucks App from within Thailand.
Privacy Policy
The Privacy Policy are integral parts of these Terms of Use. Please read the Privacy Policy carefully as when you accept these Terms of Use, you are also agreeing to the Privacy Policy.
If there is any inconsistency between these Terms of Use and the Privacy Policy, these Terms of Use shall prevail. Any matters not specified under these Terms of Use are subject to the relevant provisions of the Privacy Policy.
Minors
You acknowledge that you are at least 20 years old and are fully able to understand, agree to and abide by these Terms of Use. If you are between the ages of 13 and 20, you may only use the Online Food Ordering Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your parent or legal guardian does not agree to these Terms of Use, you must discontinue its use.
The General Terms of the Online Food Ordering Services
You can use the Online Food Ordering Services to purchase Starbucks products (“Products”) through Starbucks App in Thailand. We will designate a service provider (a “Delivery Person”) to provide the delivery service.
The Online Food Ordering Services will be provided subject to the Starbucks stores’ (each a “Store”) business hours and delivery zone restraints.
The Starbucks App will automatically match and select an appropriate Store for you when you are ordering. The Products offered and their availability at each Store may vary. The specific Products that you can purchase, their specifications, prices, etc. will show in the Starbucks App when you are ordering.
A minimum spend amount of 150 Baht (“Minimum Amount”) is applicable for each order.
30 Baht delivery charge required for the order amount of 150-299 Baht. Order 300 Baht or above, there will free of delivery charge.
In addition to the Product price, the Store will charge a delivery fee for each order. The specific amounts of the delivery fee will show in the Starbucks App when you are ordering.
A Store’s business hours, delivery zone, Products and their specifications, prices and delivery fee might change from time to time without prior notice to you. Please pay attention to such information when you are ordering.
You acknowledge and agree that Product specifications and pictures of the Products presented in the Starbucks App are for reference only. The Products you purchase through the Online Food Ordering Services may be different from the one you purchase and eat physically in a Store in terms of the packaging, appearance, taste, etc., due to the characteristics of the Product, weather, traffic, delivery time, etc.
Starbucks has the right to refuse to provide the Online Food Ordering Services to a user if he/she violates the applicable laws and regulations or acts in a dishonest manner. The said action includes, without limitation, (i) using the Online Food Ordering Services by the user to conduct illegal activities such as money laundering, theft of personal information, etc.; (ii) disrupting the normal operation of the Starbucks App, improperly interfering with the normal operation of a Store, or acting in a manner that is deemed inappropriate by Starbucks; (iii) providing fake or false information, refusing to answer the call from a Delivery Person, or refusing to accept a delivery order without justifiable reasons, causing the Delivery Person unable to deliver the Products or a severe delay in completing the delivery service, any of which action might have occurred for more than once.
You agree to abide by all applicable laws and regulations and are solely responsible for your acts or omissions in connection with your use of the Online Food Ordering Services and/or the Starbucks App.
Orders
The Starbucks App will automatically match and select an appropriate Store for you when you are ordering. This setting cannot be changed manually.
Each order shall not exceed 10 items of beverage and/or food Products. You may place another order after the completion of delivery of an order. There are other restrictions on the categories and number of Products that a user could purchase in one order. Please pay attention to such restrictions that will show in the Starbucks App when you are ordering.
The means of payment is subject to the options provided by the Starbucks App when you are ordering.
Unless otherwise as specified by Starbucks, Starbucks Delivers shall not be used in conjunction with other discounts, special or promotional offer.
Unless otherwise as specified by Starbucks, you may not use any Star Rewards, physical coupons, gift certificates, Starbucks Card eGift, Starbucks Drink eGift, etc. to redeem Product(s) or deduct product price in the use of the Online Food Ordering Services.
Please check the order carefully before you place the order. Your order is deemed effective when you receive the confirmation shown in the Starbucks App. Once the order takes effect, the Store will start preparing the food and beverage(s) immediately, and the user cannot modify or cancel the order thereafter.
You acknowledge and agree that after the Store accepts your order, in case any of the Products you ordered is unexpectedly sold out or out of stock, the Store will provide a replacement Product upon your consent or cancel your order in part or in whole. In addition, the Store will have to cancel the order due to any unforeseeable, unavoidable and insurmountable reasons that may cause the Store to be unable to provide food and beverages on time, such as internet failures, computer equipment failures, telecommunication equipment failures, electrical power failures, strikes, labour disputes, riot, protest, shortages of labour or materials, fires, floods, storms, explosions, acts of God or delays or non-performance by third parties etc. Once the order is canceled, we will refund the prices to you in the same means and way as you paid for the order or other means as we may propose and be agreed by you and us.
You will be liable for every Starbucks Delivers order made under your Starbucks App account and agree to indemnify Starbucks for all claims arising from the actions of a person submitting any order using your Starbucks App account (including the unauthorized use of your Starbucks App account by a third party).
Delivery
We may call the recipient and/or send messages to the recipient’s mobile phone number you provide us with, so that you can receive update on your order status. Besides, you may check your order status in the Starbucks App. We also recommend that you set up the Starbucks App to receive push notifications so that we can push your order status updates to you via the Starbucks App.
The delivery time as shown in the Starbucks App is only a reasonable estimate. You acknowledge and agree that the actual time required for the delivery may exceed the time estimate due to reason(s) such as weather, traffic, building access restrictions, etc.
Delivery may be delayed in the event of bad weather, traffic and/or uncontrollable conditions. Delivery may be suspended during red rainstorm warning. Delivery will be suspended during black rainstorm warning, or the hoisting of typhoon signal no. 8 or above and resumed within 2 hours of the lowering of the said warning or cancellation of the said typhoon signal.
You agree to provide us with correct and accurate information, including name, address, phone number, etc. We shall not be liable if the order fails to be delivered or the delivery is delayed due to incorrect or inaccurate information provided by you or for other reasons.
When the Delivery Person hands the Products to you or the recipient, please check the delivery pack and see if the pack is intact and unopened and if the quantity of ordered items is correct. If there is any indication that the pack has been damaged or opened already or any shortage of ordered items, please reject to accept the pack with the Delivery Person and contact us immediately.
Once the Products are delivered, the Delivery Person will confirm the order is completed in the Starbucks App system. The order’s completion time is subject to the time as shown in the Starbucks App.
Starbucks Rewards™ Program Members
The payment you make for the orders (including delivery fee) will be recorded in your Starbucks Rewards™ Stars Collection (please refer to Starbucks Rewards™ Program Terms of Use for details).
Return Policy
- Customer must do to return a product within 15 days of purchase.
- For product that eligible to returned, after Starbucks has received the returned products, customer will receive a refund into Starbucks Card which was purchased by 2-3 working day.
- The item that eligible to return would have a full refund. No option to return and replace with new item.
- Could not return product from damage which was not caused by defective of product
- Whole Bean Coffees are ineligible for any return and refund policy.
Term of Service
- In the event that product is out of stock after you confirming the order, we reserve the right to cancel your order and make a refund into Starbucks Card which was purchased
- We reserve the right to refuse any order you place with us and/or may, limit or cancel quantities purchased per order.
